The Second Circuit Court of Appeals issued two very important decisions in the Hoosick Falls, NY PFOA contamination cases this week.

Benoit v Saint Gobain
Baker v. Saint Gobain legal decision

On pages 22-23 of the Benoit decision, the Court ruled that if people can demonstrate a measurable amount of a toxin is present in their bodies, they have demonstrated an injury under New York law and may seek medical monitoring.

On pages 27-28 of this same document, the Court rules that people may pursue claims for trespass because the polluter caused PFOA to contaminate privately-owned wells.

These decisions are considered key victories for those seeking to hold polluters accountable.

The lawyer who handled the case for citizens is James Bilsborrow of Weitz and Luxenberg.
